These Terms and Conditions apply to all online services provided by Emma Mattison, under the auspices of MYZENIVERSE, LLC DBA EMMA MATTISON FITNESS (the “Company”), to any individual, regardless of age, fitness level, or health status, who wishes to participate in any online program, course, or related service (collectively referred to as the “Services”). These Services are provided through the Company's websites https://emmamattisonfitness.com and https://emmamattisonfitness.thinkific.com (collectively, the "Websites") and are hosted via platforms such as Thinkific. All Services are for informational purposes only and are not a replacement for any form of professional mental health care, medical advice, or personalized physical training. All services and communication, email or otherwise, delivered by the Company, as well as information on the Websites, are designed for adults. Anyone under the age of 18 should obtain parental or guardian consent before purchasing a program.

By purchasing or utilizing the Services, you agree to the terms stipulated in this agreement, demonstrating that you have read, understood, and wish to proceed under these conditions.

HEALTH WARNINGS AND LIABILITY DISCLAIMER

THE SERVICES PROVIDED BY THE COMPANY ARE FOR INFORMATIONAL PURPOSES ONLY. THEY ARE NOT INTENDED TO BE A REPLACEMENT FOR PROFESSIONAL MEDICAL ADVICE OR PERSONALIZED TRAINING.

BEFORE BEGINNING ANY PROGRAM, YOU SHOULD CONSULT YOUR PHYSICIAN OR OTHER HEALTH CARE PRACTITIONER AND OBTAIN MEDICAL CLEARANCE FOR EXERCISE. NOTHING STATED HEREIN IS INTENDED TO BE, AND MUST NOT BE TAKEN TO BE, THE PRACTICE OF MEDICINE OR MEDICAL ADVICE.

You should consult your physician or other health care practitioner before starting this or any exercise program or fitness activity. The programs are not a substitute for professional mental health care or medical care.

You assume all risk for the use of the content and programs. You should not utilize the programs where you have any physical, medical, or health condition that may limit your ability to safely complete the exercises.

Utilizing the programs involves a risk of personal injury, and you expressly assume all risks of harm. If at any time while performing any activity you feel discomfort or pain, you should stop immediately and contact a healthcare professional.

MEDIA RELEASE CLAUSE

If you openly tag any of Emma Mattison's or the Company's social accounts with a progress photo or review of the program(s), this act serves as a media release. If media and progress are shared privately with Emma Mattison, they will remain confidential unless express permission is given.

INSURANCE

Coaching or training services provided by the Company are generally not covered by health insurance. You are encouraged to check with your state and insurance provider to see if any incentives or support may be offered for training, based on medical necessity or other reasons.

14-DAY LEVEL GUARANTEE FOR PREMADE PROGRAMS

For one-time purchases of premade programs, there is a 14-day level guarantee. If within 14 days of purchase you find the program too easy or too challenging, Emma Mattison will unenroll you from the current program and enroll you in a more suitable one. Unenrollment removes access to videos and resources of the current program. If still unsatisfied, a full refund will be given, with no further access to any programs or videos, provided it is within the 14-day window. No refunds will be issued after 14 days from the date of purchase.

7-DAY MONEY-BACK GUARANTEE FOR ON-DEMAND MONTHLY SUBSCRIPTION

For the On-Demand Monthly Subscription, customers are entitled to a 7-day money-back guarantee. If you are unsatisfied with the service within the first 7 days from the date of sign-up, you will receive a full refund. Upon issuing a refund, access to all On-Demand Monthly Subscription benefits will be immediately revoked, including videos, resources, and any exclusive content. No refunds will be issued after 7 days from the date of purchase. After the 7-day window, you will continue to have access to the subscription benefits, and any future payments will be subject to the subscription agreement.

WAIVER

You release the Company and Emma Mattison from all claims, suits, or rights to compensation for damages you may have, including but not limited to personal injury, property damage, or other legal liabilities.

DATA SECURITY

We are committed to ensuring that your data is secure. However, you acknowledge that the use of technology is not always secure, and you accept the risks associated with the use of email, text, phone, and any other forms of communication. Payment data is processed through third-party platforms like Stripe and PayPal, and we encourage you to review their privacy policies for information about how your data is handled.

PAYMENT TERMS

Fees for services and subscriptions are listed on the Company’s Websites. Payments may be made via Stripe, PayPal, or any other payment method expressly agreed upon by the Company, depending on the product or service. Receipts and/or invoices are available, and where receipts are requested, they will be sent by email.

CANCELLATION OF SUBSCRIPTION SERVICES

You may cancel your On-Demand Monthly Subscription at any time by providing notice through the Website or by contacting customer support. Cancellations will take effect at the end of the current billing cycle, and you will retain access to the subscription services until the end of that cycle. No prorated refunds will be given for partial months. The Company reserves the right to automatically renew your subscription unless canceled prior to the renewal date.

USE OF THINKIFIC PLATFORM

Our on-demand and pre-made courses are hosted on Thinkific. By enrolling in a course or using services provided through Thinkific, you agree to Thinkific’s terms and conditions. We encourage you to review Thinkific’s Terms of Service and Privacy Policy.

SESSION FEES AND PRICE CHANGES

Subscription fees, as listed on the Websites, are subject to change at the Company’s discretion. Customers will always be provided notice prior to any price changes that affect them. Any changes will be communicated to existing users in advance, and no changes will be applied without proper notification.

MONTHLY Q&A SESSION

The Company may offer monthly Q&A sessions as part of certain programs. In the event that a Q&A session must be rescheduled or if the responsibility for the session is transferred to another qualified professional partner, you agree to these changes as part of the ongoing service. You will always be informed of such updates or changes in advance.

RIGHT TO REFUSE SERVICE

We reserve the right to, in our sole discretion, temporarily suspend, deactivate, or permanently close your account. We also reserve the right to refuse service to anyone, for any reason, at any time.

INTELLECTUAL PROPERTY RIGHTS

All content provided through the Services, including but not limited to course materials, videos, text, graphics, logos, images, and software, is the property of Emma Mattison Fitness and/or its licensors and is protected by intellectual property laws. You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute in any way any material from the Services without prior written permission from Emma Mattison Fitness. Unauthorized use of any materials may result in legal action.

FORCE MAJEURE

The Company shall not be held liable for failure or delay in performing its obligations under this agreement due to events beyond its control, including but not limited to natural disasters, strikes, internet outages, government orders, pandemics, or other unforeseen events (each a "Force Majeure Event"). The Company will make reasonable efforts to notify you of any such delays and will resume service as soon as practicable following the Force Majeure Event.

TERMINATION

Either party may terminate this agreement at any time for any reason by providing written notice to the other party. Upon termination, all rights granted to you under these Terms and Conditions shall cease, and you must immediately cease all use of the Services. If you terminate after making a payment for Services, refunds may be issued at the discretion of the Company, subject to the terms outlined in the 7-day Money-Back Guarantee or 14-day Level Guarantee.

INDEMNIFICATION

You agree to indemnify and hold harmless Emma Mattison, the Company, and its employees, contractors, licensors, and agents from and against any and all claims, losses, damages, liabilities, costs, or expenses (including attorney’s fees) arising from your use of the Services, violation of these Terms and Conditions, or violation of any third-party rights.

DISCLAIMER OF WARRANTIES

The Services are provided "as is" and without warranties of any kind, either express or implied. To the fullest extent permissible under applicable law, the Company disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The Company does not warrant that the Services will be uninterrupted or error-free, nor does it make any warranty as to the results that may be obtained from using the Services.
